SwiftSum Terms of Service
Effective Date: November 1, 2025
IMPORTANT: These Terms of Service (“Terms”) govern your access to and use of the SwiftSum website, products, and services (collectively, the “Services”). By accessing or using the Services, you confirm your acceptance of these Terms. Please read them carefully.
Section 1: Acceptance and Agreement
By accessing, browsing, or using the SwiftSum Services, you acknowledge and agree to the following:
- Legal Capacity: You confirm that you are of legal age and capacity to enter into this binding agreement.
- Compliance: You agree to comply fully with these Terms of Service.
- Nature of the Agreement: This agreement governs your use of the website and services. Your right to cancel or terminate the recurring subscription for services is governed by Section 7: Cancellation and Termination.
Section 2: Description of Services
SwiftSum provides remote financial and administrative support services to individuals and businesses. These Services include, but are not limited to:
- Remote bookkeeping and financial record maintenance.
- Financial catch-up services and basic tax support.
- Administrative staffing and support.
SwiftSum reserves the right to modify or discontinue any part of the Services at any time, with or without notice.
Section 3: Client Responsibilities
As a condition of using our Services, you agree to the following responsibilities:
- Accuracy of Information: You must provide complete, accurate, and current information, data, and documentation necessary for us to perform the Services.
- Timely Access: You must grant timely and secure access to all necessary financial tools, documents, accounts, and information requested by SwiftSum.
- Review and Feedback: You are responsible for promptly reviewing all reports, filings, and work product delivered by SwiftSum and communicating any questions, concerns, or discrepancies within a reasonable timeframe.
- Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Section 4: Billing and Payment
4.1. Fees
Fees for the Services are billed on a monthly, annual, or project basis, as agreed upon in the separate engagement agreement or statement of work.
4.2. Payment Terms
Payment is due upon receipt of the invoice or as otherwise specified in your engagement agreement. SwiftSum reserves the right to charge interest on late payments.
4.3. Consequences of Non-Payment
Late payments or failure to pay may result in the suspension, delay, or cancellation of Services.
4.4. Refund Policy
All fees paid for Services are non-refundable, except where otherwise expressly agreed upon in writing between SwiftSum and the Client.
Section 5: Confidentiality
SwiftSum recognizes the sensitivity of your financial data.
- Treatment of Information: All financial, business, and personal information you share with us is treated as strictly confidential.
- Non-Disclosure: We will not disclose your confidential data to any third party without your prior written permission, unless legally compelled to do so by court order, statute, or government regulation.
Section 6: Scope and Limitations of Services
SwiftSum is NOT a licensed Certified Public Accounting (CPA) firm, law firm, or registered investment advisor.
6.1. Nature of Advice
The Services provided are for bookkeeping and basic business advisory purposes only.
- We do not issue formal tax opinions, legal opinions, or attestations.
- Any tax-related advice is for informational and preparational purposes.
- Final filings, legal advice, and formal tax planning must be reviewed and executed by a licensed tax or legal professional.
6.2. No Guarantee
SwiftSum does not guarantee any specific financial outcome, tax savings, or profitability as a result of using the Services.
Section 7: Cancellation and Termination
7.1. Client Cancellation
You may cancel your subscription for Services at any time by providing written notice to SwiftSum. Depending on the remaining term of your agreement, you may be responsible for a final payment.
7.2. Termination by SwiftSum
SwiftSum may terminate or suspend the Services immediately, without liability, if:
- There is nonpayment of any required fees.
- We reasonably believe there is abuse of the Services or our personnel.
- You breach any of these Terms or the separate engagement agreement.
Section 8: Disclaimer of Warranties and Limitation of Liability
8.1. Disclaimer of Warranties
The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2. Limitation of Liability
To the fullest extent permitted by applicable law, SwiftSum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, lost revenue, lost data, or business interruption, arising out of or in connection with these Terms or the use of the Services.
You assume full responsibility for how you utilize the financial reports and insights provided by SwiftSum.
Section 9: Dispute Resolution and Governing Law
9.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where SwiftSum is officially registered, without regard to its conflict of law principles.
9.2. Resolution
We encourage all clients to first attempt to resolve any dispute, claim, or controversy arising out of or relating to the Services directly with us. If a resolution cannot be reached, any legal matters will be handled in the competent courts of the governing jurisdiction.
Section 10: Updates to These Terms
SwiftSum reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page, and the “Effective Date” at the top will be revised. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
